Korte beschrijving

This thesis addresses two research questions, namely to shed more light on (i) what the role of the European Union is in ensuring Kosovo’s compliance with ECtHR case law, and (ii) how the ECtHR case law on Article 10 and CoE standards have impacted legislative, judicial and administrative developments in Kosovo (a non-member state of the Council of Europe) on access to public documents, protection of whistleblowers and defamation in relation to journalistic reporting. The second question in turn is further guided by two sub-questions to determine (i) the minimum standards established by the Court and the CoE on access to public documents, protection of whistleblowers and defamation in relation to journalistic reporting, and (ii) the extent to which these standards have impacted judges, legislators and other actors in Kosovo.
